IO�A -i i 57 <br /> match the incumbent Cable System operator's PEG Access fund obligation. If <br /> said obligation exceeds twenty-five cents ($0.25) per Subscriber per month, the <br /> Grantee shall pay to the Grantor an adjustment representing the differential <br /> between the twenty-five cents ($0.25) per month per Subscriber previousty paid <br /> and what would have been paid if the amount matched the incumbent Gable <br /> System operator's renewal obfigation. Conversely, if the incumbent Cable <br /> System operator's Franchise renewal obligation is less than finrenty-five cents <br /> ($0.25) per Subscriber per month, the Grantee shall be entitled to a credit for the <br /> overpayment differential, to be applied to future PEG Access fund contributions. <br /> Grantor shall determine the appropriate adjustment payment or credit, no later <br /> than ninety (90) days after the effective date of the incumbent Cable system <br /> operator's Franchise renewal. Any such payment shall be made no later than <br /> thirty (30) days after receipt of a Grantor written demand. <br /> (b) The PEG Access grant may be used for equipment, facilities <br /> and support of both one-way video and audio PEG Access services and/or the <br /> construction, activation, and equipment for Institutional Network capacity at the <br /> Grantor's sole discretion. <br /> (c) Provision of free public building installation, the highest level <br /> of basic (non-premium) Cable Service and the highest speed regular residential <br /> Internet access service to the Priority public buildings listed in Exhibit "C," and <br /> provision of free installation, the highest level of basic (non-premium) Cable <br /> Service and interactive capability to and from the other public locations specified <br /> in Exhibit "C." <br /> (d) Exhibit "D" describes three (3) options under which Grantee <br /> shall construct a limited Institutional Nefinrork for Grantor. <br /> 40 <br /> sh/RWC/Council <br /> AGMT-382 <br /> FXS/fs <br /> 08/02/00 <br /> _ ._. _. . _.___ r _ <br />
