<br />Executive Search Services Agreement <br />Page Two <br /> <br />In the event that the City employs any additionally referred candidate in any capacity within 365 <br />days of our referral, the City will be obligated for an additional placement fee as negotiated. <br /> <br />This placement is guaranteed for a period of one year from the first day of employment. <br />Should the employee recommended and placed by our firm leave for any reason during the <br />guarantee period or be terminated for cause, we will replace that employee on a one-time <br />basis at no additional cost, except expenses incurred. <br /> <br />Peckham & McKenney carries Professional Liability Insurance ($1,000,000 limit) and <br />Commercial General Liability Insurance ($1,000,000 General Liability, $2,000,000 General <br />Aggregate, $1,000,000 Personal Injury and $2,000,000 Products). <br /> <br />In the event of any action or proceeding brought by either party to this agreement, the <br />prevailing party shall be entitled to recover all costs and fees of its attorney in such action or <br />proceeding, including cost of appeal, if any, in such amounts as are reasonable. <br /> <br />Thank you for the opportunity to be of service.
