<br />1"") .~. 131. <br /> <br />MEMORANDUM <br /> <br />August 22, 2000 <br /> <br />TO: <br /> <br />Zoning Administrator <br /> <br />FROM: <br /> <br />City Attorney <br /> <br />RE: <br /> <br />RESOLUTION FINDING AND DECLARING CONTINUING NEED <br />FOR ORDINANCE REGULATING ON-PREMISES ADVERTISING <br />THAT IS MORE RESTRICTIVE THAN EXISTING LAW <br /> <br />Pursuant to Ordinance No. 2161, adopted June 28,1999 and as amended <br />by Ordinance No.2184, adopted January 10, 2000 (collectively, the "Sign <br />Ordinance"), revised sign regulations were enacted by the City Council. Those <br />regulations include an amortization schedule for various kinds of signs, which are <br />more restrictive than those in existence prior to the adoption of the new Sign <br />Ordinance. As you are aware, Business and Professions Code Section 5491.1 <br />requires the City to identify and inventory all non-conforming signs because the <br />new ordinance is more restrictive than the preexisting regulations. <br /> <br />A public hearing was held on the identification of signs and inventory on <br />May 22, 2000. Upon the conclusion of the public hearing the City Council <br />determined that the more restrictive regulations are justified, and that no <br />revisions to the amortization schedule, or other provisions of the Sign Ordinance, <br />should be made. <br /> <br />Under Business and Professions Code Section 5491.1, the Council must <br />confirm that there is a continuing need for the more restrictive regulations. The <br />attached resolution includes findings and a declaration to that effect. <br /> <br />The resolution merely confirms in formal form the action taken by the <br />Council. Accordingly, it may be included on the consent calendar of a future <br />Council meeting. <br /> <br />If you have questions regarding the foregoing, please do not hesitate to <br />contact me. <br /> <br />David E.
