The reqaired fee of $100 has previousfy <br /> h�en delivered to you,by Mr, Michaef King, a member of the Owner. <br /> As the City is aware, the ground ffoor of the subject property is occupied by <br /> ih'ashingt�n Mutuaf and Stewart 'Fitle pursuant io buifdir�g and occupancy perrnits <br /> wnich were issued by the City. Because the Owner has reasonably refied on <br /> permits issued by the City in the expenditure of signifcarit funds and the Ownsr's <br /> agreement to signi�icant eorttractual on(igations under two lea5es, appficab{e law <br /> grants the Owner "vested rights" to continue such uses. Tne Owner's position <br /> that it holds vested rights ta continue such uses nas previousiy been <br /> communicated to City s�aff in the p�anning department and the City Attorney's <br /> of��ce. � <br /> However, in an effort to maintain good� rplations wlth the City, the Ow�er agreed, <br /> af the request of the City, to apply fQr a Use Psrmit. This agreemertt was based <br /> �upan the expec;ation, commu�icated by members of City staff in a meeting on <br /> this tapic, that it�was likefy the �arties cou�d compromise upon reasonable � <br /> conditions to be included in such permit. <br /> The Ownsr clearly communicated to the City througf�out the application process <br /> ths uses of the Property to which the City now objects . The C'rty issued all <br /> necessary permits, approved fiira! inspections, and permitted occupancy by the <br /> two users. No speciaf condi�ions or mitiga�ions were attached to such permits, � <br /> evidencing the Owner's fulf compfiance with appficable ordinances fo� the <br /> proposed uses. <br />
