!
REPORT
To the Redevelopment Agency
October 16, 2000
Subject
Agreement for Environmental Special Counsei Services — Law Offices of William A.
Falik
Recommendation
That the Redevelopment Agency Board approve the subject agreement by resolution.
Background
An Environmental Impact Report (EIR) is being prepared for the Downtown Retail/Cinema
Project. As part of this process, the Agency Attorney recommends contracting with special
counsel to review the EIR and prepare the administrative record required by the California
Environmental Quality Act (CEQA). As the Board knows, EIR's are often the point of
challenge to high profile projects. In this instance, the City Attorney believes it is important
to use special counsel to ensure that there are no procedural issues that might be raised
in connection with the project. William Falik has specific experience with such CEQA
review issues and is therefore recommended to the Board.
Fiscal Impact
The Redevelopment Agency will pay expenditures under this agreement. Staff
recommends that the Board establish a not-to-exceed expenditure cap of $50,000.
This agreement will come back to the Agency Board if costs exceed this cap.
. "
Michael Church d E er
Executive Director City Manager
.. _ . ._ _ _ r _._ . ._.. .
