C7 <br /> <br />AGREEMENT <br /> <br />PROFESSIONAL CONSULTING ENGINEERING AND DESIGN SERVICES <br /> <br />THIS AGREEMENT, made and entered into this <br /> <br />day of <br /> <br />2000, by and between the CITY OF REDWOOD CITY, a municipal corporation of the <br /> <br />State of California, ("City"), and KENNEDY/JENKS CONSULTANTS of Palo Alto, <br /> <br />California ("Consultant"); <br /> <br />WITNESSETH: <br /> <br />WHEREAS, City requires a feasibility study of the Broadway Water Storage <br /> <br />Tank and Booster Pump Station in the City of Redwood City (the "Projecf'); and <br /> <br />WHEREAS, in connection with the Project, the City requires professional <br /> <br />consulting engineering and design services; and <br /> <br />WHEREAS, Consultant represents that it possesses the experience, and is <br /> <br />qualified to perform the aforesaid services for the Project; <br /> <br />NOW, THEREFORE, the parties hereto agree as follows: <br /> <br />1. <br /> <br />CONSULTANT'S SERVICES. <br /> <br />Consultant shall prepare construction <br /> <br />documents and perform consulting engineering and design services described in <br /> <br />Exhibit "A" hereof, attached hereto and by this reference incorporated herein. <br /> <br />2. <br /> <br />COMPENSATION: EXPENSES: PAYMENT. City shall compensate <br /> <br />Consultant for all services performed by Consultant hereunder in an amount based <br /> <br />upon Consultant's hourly rates set forth in Exhibit A. <br /> <br />Notwithstanding the foregoing, the combined total of compensation and costs <br /> <br />payable hereunder shall not exceed the sum of Forty-four Thousand and No/100 <br /> <br />Agmt-419 <br />F :\shared\Redwood\Council <br />FX8:djk <br />11/06/00 <br /> <br />1 <br /> <br />'~"-----'.~-T .. <br />
