<br />7- ., - liB <br /> <br />CONCLUSIONS AND ULTIMATE FINDINGS <br /> <br />Based upon the foregoing, the consideration of all public testimony, a comprehensive review of <br />the DEIR and the FEIR (collectively, the "EIR"), and substantial evidence in the Administrative <br />Record, the City Council finds and determines, that: <br /> <br />(1) The EIR has adequately addressed all the issues raised in the appeal; <br /> <br />(2) The proposed project, located in the CBR district of downtown, would be exempt'from the <br />Interim Urgency Ordinance because a Development Agreement (DA) and Disposition and <br />Development Agreement (DDA) would be required as part of the project approval process; <br /> <br />(3) The Interim Urgency Ordinance does not constitute new information of significance that <br />would warrant further environmental analysis; <br /> <br />(4) The EIR adequately considers a housing land-use on the Project site and analyzes a potential <br />mixed-use project with a housing component in Alternative 2; <br /> <br />(5) The EIR adequately analyzes the parking needs generated by the project using a <br />professionally accepted model of Shared Parking; and <br /> <br />(6) The EIR adequately analyzes cumulative traffic impacts (to 2020) using a methodology that <br />incorporates, not only local, but regional impacts as well. <br /> <br />Based upon the above findings and determinations, the appeal of the Planning Commission's <br />Certification of the FEIR for the Downtown Retail-Cinema Project shall be deemed denied in <br />accordance with the provisions of this document. <br /> <br />Dated: <br /> <br />,2000 <br /> <br />CITY OF REDWOOD CITY, <br />A municipal corporation <br /> <br />By: <br /> <br />Mayor <br /> <br />ATTEST: <br /> <br />City Clerk <br /> <br />(SEAL) <br /> <br />CERTIFICATION <br /> <br />The Council of Redwood City approved the foregoing findings and conclusions at a regular <br />meeting thereof on November 27,2000, by motion duly made and carried. <br /> <br />Dated: <br /> <br />,2000 <br /> <br />City Clerk <br /> <br />7 <br />
