�� �-A9 <br /> CONCLUSIONS AND ULTIMATE FINDINGS <br /> Based upon the foregoing, the consideration of all public testimony, a comprehensive <br /> review of the DEIR and the FEIR (collectively, the "EIR°), and substantial evidence in <br /> the Administrative Record, the City Council finds and determines, that: <br /> (1) The EIR has adequately addressed all the issues raised in the appeal; <br /> (2) The proposed project, located in the CBR district of downtown, would be exempt <br /> from the Interim Urgency Ordinance because a Development Agreement (DA) and <br /> Disposition and Development Agreement (DDA) would be required as part of the <br /> project approval process; <br /> (3) The Interim Urgency Ordinance does not constitute new, information of significance <br /> that would warrant further environmental analysis; <br /> (4) The EIR adequately considers a housing land-use on the Project site and analyzes a <br /> potential mixed-use project with a housing component in Alternative 2; <br /> (5) The EIR adequately analyzes the parking needs generated by the project using a <br /> professionally accepted model of Shared Parking; and <br /> (6) The EIR adequately analyzes cumulative traffic impacts (to 2020) using a <br /> methodology that incorporates, not only local, but regional impacts as well. <br /> Based upon the above findings and determinations, the appeal of the Planning <br /> Commission's Certification of the FEIR for the Downtown Retail-Cinema Project shall be <br /> deemed denied in accordance with the provisions of this document. <br /> Dated: , 2000 CITY OF REDWOOD CITY, <br /> A municipal corporation <br /> By: <br /> Mayor <br /> ATTEST: <br /> City Clerk <br /> - (SEAL) <br /> CERTIFICATION <br /> The Council of Redwood City approved the foregoing findings and conclusions at a <br /> regular meeting thereof on December 18, 2000, by motion duly made and carried. <br /> Dated: , 2000 <br /> City Clerk <br /> 8 <br /> _ _ _ . _ _ _ _.,.__ _ . .
