<br />r¡ <br />¡ <br />I <br /> <br />officers, directors, employees, attorneys, consultants, predecessors and <br />successors In interest, heirs, and assigns, arising out of the subject matter of the <br />action described above. <br /> <br />4. ~ettlement Amount. The settlement amount for the Relinquishment of <br />Access to the City of Redwood City for the benefit of the public is the sum of <br />Nineteen Thousand Two Hundred Seventy-Five Dollars ($19,275). The sum of <br />Nine Thousand Two Hundred Seventy-Five Dollars ($19,275) shall be deemed to <br />be the fair market value for the Relinquishment of Access. <br /> <br />5. Conveyance of Title. (a) Novak agrees to execute a Relinquishment of <br />Access in favor of City In a form attached hereto and marked Exhibit "C" and <br />deliver same to City for execution of this Agreement for the purpose of allowing <br />City to affix thereto its Certificate of Acceptance. <br /> <br />Escrow. Novak and City agree to open an escrow (the "Escrow") . <br />ac rdance with this Agreement with First American Title Insurance Comp' y, <br />('.Es ow Agenr), 555 Marshall Street, Redwood City, California. This <br />Agree nt constitutes the joint escrow instructions of Buyer and S er, and <br />Escrow ent to whom these instructions are delivered is hereby e owe red to <br />act under 's Agreement. The parties hereto agree, subject to e conditions <br />set forth bel t to do all acts necessary to close this escro In the shortest <br />possible time. <br /> <br />Prior to or concurre with the opening of Escrow, No shall deliver to City an <br />executed original Ag ment and a Rellnqulshmen of Access in favor of City <br />and request that said nt Deed be delivere 0 .Escrow Agent with City's <br />certificate of acceptance a ched thereto. Nov and City agree to deposit with <br />Escrow Agent any additional struments as ay be necessary to complete this <br />transaction under the terms an ondition set forth herein. <br /> <br /> <br />~ <br /> <br />AU funds received in this Escrow ay be deposited with other funds In the <br />general Escrow and may be t ns rred to any other such Escrow Trust <br />Accounting with Escrow Agent thin th tate of California.
