<br />DES:djg-c <br />~S:djg:-c <br />OES:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02115/83R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />35. <br /> <br />CAPTIONS. <br /> <br />Paragraph and subparagraph headings used here- <br /> <br />in are for convenience, only, and shall not be deemed to alter or <br /> <br />modify the contents of the paragraph or subparagraph which they <br /> <br />head. <br /> <br />36. <br /> <br />SEVERABILITY. <br /> <br />Should any of the covenants, conditions or <br /> <br />terms of this lease agreement be held by a court of competent <br /> <br />jurisdiction to be illegal or in conflict with any applicable law, <br /> <br />or with any provisions of the Charter of the City of Redwood City, <br /> <br />the validity of the remaining portions or provisions shall not be <br /> <br />affected thereby. <br /> <br />37. <br /> <br />INTEGRATION. <br /> <br />This document constitutes the whole agree- <br /> <br />ment between Lessor and Lessee. <br /> <br />There are no terms, obligations <br /> <br />or conditions other than those contained herein. <br /> <br />38. <br /> <br />PRIOR LEASE. <br /> <br />The parties acknowledge that, pursuant to <br /> <br />Resolution No. P-IO18 entitled "Resolution Approving Assignment <br /> <br />of Lease - Petroleum Terminal Facilities" adopted March 4, 1982 <br /> <br />by Lessor's Board of Port Commissioners, Lessor herein, as lessor <br /> <br />under that certain lease agreement dated October 24, 1963 and <br /> <br />subsequent supplemental agreements thereto (collectively, the <br /> <br />"Prior Lease") by and between Lessor and Texaco Inc., a Delaware <br /> <br />Corporation as lessee thereunder, consented to the assignment of <br /> <br />the Prior Lease by said Texaco, Inc. to Lessee herein. <br /> <br />This <br /> <br />lease agreement shall and does hereby supersede the Prior Lease. <br /> <br />39. <br /> <br />GOVERNING LAW. <br /> <br />The laws of the State of California shall <br /> <br />42 <br /> <br /> <br />'-r---'" -.-y---""".---"'."--."""'.'-' <br />
