<br />DES:djg-c <br />'ES:djg-c <br />DES:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02/15/,83R <br />07/29¡'83R <br />11/20/83R <br />l2/08/83R <br /> <br />of Redwood City by land transportation. <br /> <br />Therefore, Lessee agrees <br /> <br />to pay tariff charges applicable to water transportation on all <br />petroleum products received at the Port of Redwood City by or for <br /> <br />the account of Lessee by means of pipeline, rail car, truck, or <br /> <br />other method of land transportation in the same manner and amount <br /> <br />as if such products had been received by water transportation. <br /> <br />During the term of this lease Lessee shall keep separate <br /> <br />records of all petroleum products received by or for its account <br /> <br />at the Leased Premises by water and land transportation. <br /> <br />At the <br /> <br />end of each month during the term hereof Lessee shall report in <br /> <br />writing to Lessor the total quantity of petroleum products received <br /> <br />by or for Lessee's account by water transportation and by land <br /> <br />transportation during the preceding month, <br /> <br />Lessor shall thereafter <br /> <br />submit to Lessee a statement of tariff charges applicable to <br /> <br />petroleum products received by land and water transportation. <br /> <br />Such <br /> <br />charges shall be paid by Lessee to Lessor within thirty (30) days <br /> <br />after receipt of said statement. <br /> <br />It is further the intent of the parties that Lessor's <br /> <br />applicable tariff charges shall be imposed only once on any <br /> <br />commodity except with respect to charges on bunker fuel sold or <br /> <br />provided to vessels at the Port of Redwood City by Lessee. <br /> <br />Therefore, wharfage charges shall be imposed on shipments received <br /> <br />by Lessee (both by water and land transportation) and will not be <br /> <br />imposed a second time when the commodities are removed from the <br /> <br />6 <br /> <br />..........-.......~....,.......... ...............-.. <br />
