<br />and other forms or documentation which are required and forward <br /> <br />them to the Risk Manager (Assistant to the Executive Director) of <br /> <br />the JPB with the required evidence of insurance. <br /> <br />All policies will be issued by insurers acceptable to <br /> <br />the JPB. <br /> <br />(f) <br /> <br />Performance Bond. <br /> <br />Each of City's construction <br /> <br />contractor(s) shall maintain in full force and effect, until <br /> <br />completion (including clean up) and acceptance of the work <br /> <br />specified in its contract, performance bonds in the amount of the <br /> <br />contract price, naming the City as beneficiary thereon. <br /> <br />11. <br /> <br />Construction on Railroad Property. <br /> <br />In the event <br /> <br />any of the work on the Structure is undertaken on or adjacent to <br /> <br />property of the Railroad, and advertised for bid by the City, the <br /> <br />awarded contract shall include the provisions set forth in <br /> <br />Exhibit D, which is attached to this Agreement and incorporated <br /> <br />into it by this reference. <br /> <br />City shall assure that said work <br /> <br />shall not commence, and City's contractor shall not enter onto <br /> <br />the Railroad's property for any purpose, until: <br /> <br />(a) <br /> <br />Contractor has signed the Right of Entry <br /> <br />Agreement attached to this Agreement as Exhibit C; and <br /> <br />(b) <br /> <br />City has furnished to Railroad's authorized <br /> <br />engineer a copy of said Right of Entry Agreement executed by <br /> <br />contractor and a certificate of insurance evidencing the <br /> <br />procurement of the insurance required in said Right of Entry <br /> <br />Agreement; and <br /> <br />217831.2 <br /> <br />-16- <br /> <br />.
