<br />DES:djk C <br /> <br />24/91 <br /> <br />(028/44) <br /> <br />insurance <br /> <br />shall <br /> <br />also <br /> <br />specifically <br /> <br />insure <br /> <br />any <br /> <br />contractual <br /> <br />liabili ty assumed by Owner under the terms of this agreement, <br /> <br />including, <br /> <br />but <br /> <br />not <br /> <br />limited to, <br /> <br />the provisions of <br /> <br />Paragraph <br /> <br />1 <br /> <br />above. <br /> <br />5. <br /> <br />MONUMENTS. <br /> <br />All <br /> <br />pipes <br /> <br />and <br /> <br />monuments <br /> <br />shown <br /> <br />on <br /> <br />the <br /> <br />subdivision map hereinafter <br /> <br />referenced which are <br /> <br />destroyed <br /> <br />or <br /> <br />displaced during construction operations <br /> <br />shall be <br /> <br />replaced by <br /> <br />Owner at the time of the final inspection of the Improvements, if <br /> <br />any, hereunder by City. <br /> <br />6. <br /> <br />OWNERSHIP OF IMPROVEMENTS. <br /> <br />It is agreed that title and <br /> <br />to <br />~ <br />Q <br />to <br />to <br />..... <br />to <br />N <br /> <br />ownership of all Improvements constructed for the benefit of City <br /> <br />hereunder by Owner shall vest absolutely in City upon completion <br /> <br />and acceptance of such Improvements by City. <br /> <br />7. <br /> <br />WORK SUBJECT TO APPROVAL. <br /> <br />All work provided <br /> <br />for in <br /> <br />this <br /> <br />agreement <br /> <br />and <br /> <br />more <br /> <br />specifically <br /> <br />described <br /> <br />in <br /> <br />the <br /> <br />specifications herein referenced shall be subject to the approval <br /> <br />and acceptance by the City Engineer before the release of any <br /> <br />security required herein. <br /> <br />Reference is hereby made to <br /> <br />( a) <br /> <br />that <br /> <br />certain final map entitled, "Laguna pointe Subdivision" (b) those <br /> <br />certain <br /> <br />specifications <br /> <br />entitled, <br /> <br />"Technical <br /> <br />Specifications <br /> <br />for <br /> <br />Laguna Pointe Subdivision" and (c) those certain plans on file in <br /> <br />the office of the City Engineer entitled, "Improvement Plans for <br /> <br />Laguna Pointe Subdivision", for a more particular description of <br /> <br />the work and Improvements generally described in this agreement. <br /> <br />Said <br /> <br />final <br /> <br />map, <br /> <br />plans <br /> <br />and <br /> <br />specifications <br /> <br />referenced <br /> <br />in <br /> <br />this <br /> <br />paragraph are hereby incorporated herein and made a part of this <br /> <br />agreement. <br /> <br />Upon completion of the aforementioned work, and prior <br /> <br />6 <br /> <br />-,........~.. <br />
