<br />FXS:cb 0 <br /> <br />11/91 (004/30) <br /> <br />1. <br /> <br />Resolutions <br /> <br />No. <br /> <br />11212, <br /> <br />entitled <br /> <br />"Improvements <br /> <br />for <br /> <br />Promontory Point at Shorebird Island Subdivision" and Resolution <br /> <br />No. 11247, <br /> <br />entitled <br /> <br />"Amendment <br /> <br />to <br /> <br />Agreement <br /> <br />Improvements <br /> <br />for <br /> <br />Promontory <br /> <br />Point <br /> <br />at <br /> <br />Shorebird <br /> <br />Island <br /> <br />Subdivision" <br /> <br />are <br /> <br />hereby <br /> <br />rescinded. <br /> <br />2. <br /> <br />That certain final map <br /> <br />(including any dedications of <br /> <br />easements <br /> <br />described <br /> <br />therein) <br /> <br />entitled <br /> <br />Promontory <br /> <br />Point <br /> <br />at <br /> <br />Shorebird <br /> <br />Island <br /> <br />Subdivision, <br /> <br />in <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />Redwood <br /> <br />City, <br /> <br />prepared <br /> <br />by Art <br /> <br />Bliss <br /> <br />Engineering, <br /> <br />Inc. , <br /> <br />civil <br /> <br />engineer, <br /> <br />for <br /> <br />1>1ohammad Mortazavi and Leon J. Klapper, of Hillsborough and San <br /> <br />Mateo, <br /> <br />California, <br /> <br />respectively, <br /> <br />the owners of record of said <br /> <br />subdivision, <br /> <br />(hereinafter collectively referred to as <br /> <br />1I0wner") <br /> <br />heretofore determined by the City Engineer as conforming to the <br /> <br />tentative <br /> <br />map <br /> <br />for <br /> <br />said <br /> <br />subdivision, <br /> <br />is <br /> <br />approved <br /> <br />and <br /> <br />accepted <br /> <br />subject to the following conditions: <br /> <br />(a) <br /> <br />Before the release of said final map by the City <br /> <br />of <br /> <br />Redwood <br /> <br />City <br /> <br />("City") <br /> <br />for <br /> <br />recordation, <br /> <br />the <br /> <br />owner <br /> <br />or <br /> <br />subdividers <br /> <br />(hereinafter <br /> <br />"Owner" <br /> <br />shall mean <br /> <br />the <br /> <br />owner <br /> <br />or <br /> <br />subdividers, as specified in the application for approval of <br /> <br />the subdivision) <br /> <br />of said subdivision shall enter into and <br /> <br />execute that certain proposed subdivision agreement on file <br /> <br />in the office of the City Clerk, <br /> <br />entitled <br /> <br />"Agreement <br /> <br />for <br /> <br />Improvement <br /> <br />of <br /> <br />Promontory <br /> <br />Point <br /> <br />at <br /> <br />Shorebird <br /> <br />Island <br /> <br />Subdivision" <br /> <br />(form <br /> <br />dated <br /> <br />05/07/91) <br /> <br />wherein <br /> <br />Owner, <br /> <br />in <br /> <br />consideration for the approval of said map by City, <br /> <br />shall <br /> <br />agree to construct and complete in the <br /> <br />time <br /> <br />specified in <br /> <br />said agreement, all improvements required of Owner under the <br /> <br />2 <br /> <br />"--" T" <br />
