REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />November 13, 2017 <br /> <br />SUBJECT <br />Second Reading of Zoning Ordinance Amendments Regarding Cannabis Cultivation <br />and Commercial Cannabis Activity <br /> <br />RECOMMENDATION <br />Waive Second Reading and Adopt the Ordinance to Amend Article 59 of the Zoning <br />Ordinance <br /> <br />BACKGROUND <br />On October 23, 2017, the City Council introduced and approved amendments to Article <br />59 of the Zoning Ordinance related to cannabis cultivation and commercial cannabis <br />activity. This is the second reading of that ordinance, as required by law. A link to the <br />October 23 meeting agenda is provided here. <br /> <br />On October 23, the City Council also provided direction on future regulation of <br />cannabis-related activity, and staff will return with proposed regulations in spring 2018. <br /> <br />ANALYSIS <br />The amendments contained in the Final Ordinance (Attachment 1) repeal Article 59 of <br />the Zoning Ordinance in its entirety and replace it with express provisions limiting indoor <br />cultivation to six cannabis plants, banning all outdoor cultivation, and banning all <br />commercial cultivation, manufacturing, testing, retail and distribution, except for <br />deliveries. <br /> <br />If adopted, this ordinance will be effective 30 days from this action (December 13, <br />2017). <br /> <br />ALTERNATIVES <br />The City Council may choose to not adopt the ordinance or reintroduce the ordinance <br />with changes. <br /> <br />FISCAL IMPACT <br />No fiscal impact is expected with this change. <br /> <br /> <br /> <br />6.4.B. - Page 1
