5. ORAL COMMUNICATIONS AND CONSENT CALENDAR <br />Elizabeth Travers stated staff told her that all water billings after July 1 would be at <br />the new rate. Upon challenging the legality of the billing, staff told her that the bill <br />would be reconfigured and her account would be credited for the overcharge. She <br />suggested legal review of the discrepancies in the billings and lack of notification of <br />water rate increases. She further stated that it is unfair to charge the highest rate for <br />every unit in the highest category. She gave an update on Stafford Park stating that <br />a couple of years ago when decibel monitoring equipment was brought to the park, <br />the noise seemed to go down but last Wednesday it was horrible. She called the <br />Police Department asking to speak with the person on duty, an hour later PRCS <br />Superintendent Chris Beth and a police officer responded. When asked how the <br />noise registered on the decibel monitor she was told that monitoring has not <br />occurred for two years since it was within normal range. Ms. Travers stated that in <br />March a letter went to the Civic Cultural Commission asking consideration to move <br />the concerts to an area with more parking such as Mezes, Redwood Shores or Red <br />Morton Park. She further expressed concern that the concerts have been advertised <br />such that attendance could reflect that of a regional park rather than a neighborhood <br />park. <br />Jack Hickey shared an article regarding eminent domain that he received from the <br />Reason Foundation, an organization that analyzes public policy. He stated that his <br />packet of information for Council includes a city ordinance dealing with how to define <br />the aspects of eminent domain, what is private property and what are private uses. <br />The other item is a resolution that might be considered to send to the state and <br />congress to overturn the Supreme Court's decision or at least clarify the decision so <br />that property owners might be secure in their property. He encouraged review of the <br />documents, stating that enacting this legislation would go far in restoring the <br />credibility and confidence in the city. <br />M/S Foust/Howard waive reading of the Consent Calendar except the ordinances by <br />title, adopt the resolutions and the ordinances, and approve other items. Council <br />Member Bain removed Item 5.1.H. for separate discussion. The motion passed by <br />a unanimous roll call vote. <br />5.1 Section— Motions <br />A.
