...5"./ -/ RIZPORT To the Honorable Mayor and City Council From the CitMana .er August 22, 2005 Subject Approval of a Construction Improvements Agreement for 585 Whipple Avenue Recommendation Approve the plans and authorize execution of a construction improvement agreement with Oyster and Oyster Investments, owners of record of said real property located at 585 Whipple Avenue, Redwood City, California ("Owners"). Background On September 15, 2004, the Planning Director approved both the Use and Architectural Permits for Oyster and Oyster Investments, to construct a new service station with eight fuel stations, a 2,200 square foot market, and a car wash, at 585 Whipple Avenue. The new building is located at the intersection of Whipple Avenue and Winslow Street. The Permits' conditions require the developer to construct certain public street improvements to provide services to the new station, and to protect the general welfare of the public. The improvements consist of replacing the curb, gutter,qnd sidewalk across the frontage of the property, water and sewer services to the pr6perty, fire hydrants, street trees, and miscellaneous related improvements. Engineering & Construction has approved the plans for the improvements submitted by the developer, Oyster and Oyster Investments and their civil engineering consultant firm, Gettler-Ryan, Inc. According to Section 29.95, Article VII, Chapter 29 of the City Code, a Construction Improvement Agreement with City is required. The developer is required to post Faithful Performance and Payment Bonds, each in the amount of $173,000.
