<br />..6:ðA -I <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />To the Honorable Redevelopment Agency Board <br />From the City Manager and Executive Director <br /> <br />August 22, 2005 <br /> <br />Subject <br />Right of Entry Agreement for First Community Housing <br /> <br />Recommendation <br />Approve Right of Entry Agreement allowing First Community Housing to access Lincoln <br />Avenue property for temporary construction staging. <br /> <br />Background <br />The Agency Board and City Council approved a Development and Disposition <br />Agreement (DDA) with First Community Housing (FCH) for the Villa Montgomery <br />development of 58 affordable housing units at the corner of EI Camino and Vera <br />Avenue. An additional 8 units are to be built by Peninsula Habitat for Humanity <br />(Habitat) at Lincoln Avenue. The DDA provided for the subsequent transfer of land to <br />FCH and Peninsula Habitat for Humanity. FCH estimates that an escrow will close in <br />August and the EI Camino Vera Avenue parcels will be transferred to FCH at that time. <br /> <br />It was originally anticipated that land transfer to FCH and Habitat would occur at the <br />same time and Habitat would provide FCH access to the Lincoln Avenue parcels for <br />construction staging and access to their property. Since Habitat is not scheduled to <br />accept land transfer until spring of 2006, the Lincoln Avenue parcels will remain in title <br />to the Redevelopment Agency. In order for construction to begin, FCH requests to <br />access their property from the Lincoln Avenue site. <br /> <br />The Council and Agency are being requested to approve a Right of Entry Agreement <br />with First Community Housing. This Agreement will allow FCH access to the Lincoln <br />Avenue property to be used for construction staging beginning approximately August <br />24,2005 and ending January 31,2006. <br /> <br />A Resolution authorizing approval granting a Right of Entry Agreement to FCH for this <br />project is attached to this report.
