..6:ðA -I

REPORT

To the Honorable Mayor and City Council
To the Honorable Redevelopment Agency Board
From the City Manager and Executive Director

August 22, 2005

Subject
Right of Entry Agreement for First Community Housing

Recommendation
Approve Right of Entry Agreement allowing First Community Housing to access Lincoln
Avenue property for temporary construction staging.

Background
The Agency Board and City Council approved a Development and Disposition
Agreement (DDA) with First Community Housing (FCH) for the Villa Montgomery
development of 58 affordable housing units at the corner of EI Camino and Vera
Avenue. An additional 8 units are to be built by Peninsula Habitat for Humanity
(Habitat) at Lincoln Avenue. The DDA provided for the subsequent transfer of land to
FCH and Peninsula Habitat for Humanity. FCH estimates that an escrow will close in
August and the EI Camino Vera Avenue parcels will be transferred to FCH at that time.

It was originally anticipated that land transfer to FCH and Habitat would occur at the
same time and Habitat would provide FCH access to the Lincoln Avenue parcels for
construction staging and access to their property. Since Habitat is not scheduled to
accept land transfer until spring of 2006, the Lincoln Avenue parcels will remain in title
to the Redevelopment Agency. In order for construction to begin, FCH requests to
access their property from the Lincoln Avenue site.

The Council and Agency are being requested to approve a Right of Entry Agreement
with First Community Housing. This Agreement will allow FCH access to the Lincoln
Avenue property to be used for construction staging beginning approximately August
24,2005 and ending January 31,2006.

A Resolution authorizing approval granting a Right of Entry Agreement to FCH for this
project is attached to this report. A full copy of the Right of Entry Agreement is available
for review in the Office of the City Clerk and the Redevelopment, Housing & Economic
Development Division.

REDEVSHARED_2005 STAFF REPORTS_08-2005_Right of Entry Agreement FCH

1
