NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained <br />herein, the Parties agree as follows: <br />1. All of the recitals set forth above are true, correct, and are hereby incorporated in this <br />Amendment as if fully set forth herein. <br />2. Article 4 (Selection of Consultants and Funding of City Costs) of the Original <br />Agreement is amended to add Section 4.05, Shasta Triangle Costs, as follows: <br />4.05. Shasta Triangle Costs. Developer shall reimburse the City for all costs <br />associated with the Action and any other action taken in an attempt to secure title <br />interest in the Shasta Triangle in furtherance of development of the Project, from <br />the date of execution of this Agreement. The Parties agree that all costs and <br />expenses incurred and to be incurred by Developer relating to Condition No. 31, <br />securing title interest in the Shasta Triangle, and the Action are incurred and shall <br />be borne solely by Developer, regardless of the outcome of such efforts to secure <br />such title interest. <br />3. All other provisions of the Agreement will remain in full force and effect. <br />4.
