REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />December 18, 2017 <br /> <br />SUBJECT <br />Approval of the General and Special Release to Resolve Litigation in Catherine Pugel, <br />et al. v. Young Shik Kim, et al. <br /> <br />RECOMMENDATION <br />By motion, approve settlement as memorialized in the General and Special Release in <br />Catherine Pugel, et al. v. Young Shik Kim, et al. <br /> <br />BACKGROUND <br />This is a lawsuit by Catherine and Thomas Pugel against Young Shik Kim and the City <br />of Redwood City arising out of a trip and fall which allegedly occurred on or about <br />September 22, 2015 adjacent to 875 Walnut Street. At the mediation held on November <br />17, 2017, the parties reached a global settlement for $100,000, whereby the City would <br />pay $90,000 towards the settlement and Mr. Kim would pay $10,000. These terms <br />have been memorialized in a General and Special Release signed by Mr. and Mrs. <br />Pugel and their attorney. <br /> <br />ANALYSIS <br />The City Attorney’s Office recommends approval of the settlement as delineated in the <br />General and Special Release. <br /> <br />ALTERNATIVES <br />The City Council could elect not to approve the settlement. <br /> <br />FISCAL IMPACT <br />The settlement proceeds will be withdrawn from the City’s general liability fund. <br /> <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in the CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br /> <br />6.1.D. - Page 1
