HOGAN acknowledges and agrees that she has <br /> <br />been advised of her rights to obtain an attorney of her choice to advise her with respect to <br /> <br />the matters which are the subject of this Release, that her attorneys have discussed this <br /> <br />Release with her and have fully advised her with respect to the rights and obligations she <br /> <br />assumes by executing this document, and that she has not relied on the opposing party's <br /> <br />attorney for any advice on or interpretation of this Agreement. The parties expressly <br /> <br />acknowledge that they enter into this Release freely and voluntarily. <br /> <br />9. <br /> <br />Modifications. This Release may only be varied or modified by a written <br /> <br />document signed by both parties. <br /> <br />10. <br /> <br />Enforcement of Agreement. In the event any proceeding is commenced <br /> <br />with respect to construing or enforcing any provision of tlüs Agreement, the prevailing <br /> <br />party (in addition to all other sums to which such party may be entitled) shan be paid by <br /> <br />the other party a reasonable amount for attorneys' fees and costs incurred. <br /> <br />11. <br /> <br />Governing Law.
