in equity brought by either of the parties will be tried in a court <br />of competent jurisdiction in the County of San Mateo, and the parties waive all other <br />provisions of law providing for a change of venue in these proceedings to any other county. <br />E. Contractor must have a City of Redwood City Business License prior to start of work. <br />VIII. BUY AMERICA <br />A. Furnish steel and iron materials to be incorporated into the work with certificates of <br />compliance. Steel and iron materials must be produced in the U.S. except: <br />1. Foreign pig iron and processed, pelletized, and reduced iron ore may be used in the <br />domestic production of the steel and iron materials [60 Fed Reg 15478 (03/24/1995)]; <br />2. If the total combined cost of the materials does not exceed the greater of 0.1 percent of <br />the total bid or $2,500, materials produced outside the U.S. may be used. <br />B. Production includes: <br />1. Processing steel andiron materials, including smelting or other processes that alter the <br />physical form or shape (such as rolling, extruding, machining, bending, grinding, and <br />drilling) or chemical composition; <br />2. Coating application, including epoxy coating, galvanizing, and painting, that protects or <br />enhances the value of steel and iron materials. <br />IX. FHWA FORM 1273 <br />A. Form FHWA-1273 (Section 00690) is part of this contract. Comply with its provisions. <br />X. USE OF UNITED STATES -FLAG VESSELS <br />A. The CONTRACTOR agrees - <br />1. To utilize privately owned United States -flag commercial vessels to ship at least 50 <br />percent of the gross tonnage (computed separately for dry bulk carries, dry cargo liners, <br />and tankers) involved, whenever shipping any equipment, material, or commodities <br />pursuant to this contract, to the extent such vessels are available at fair and reasonable <br />rates for United States -flag commercial vessels. <br />2. To Furnish within 20 days following the date of loading for shipments originating within the <br />United State or within 30 working days following the date of loading for shipments <br />originating outside the United States, a legible copy of a rated "on -board" commercial <br />ocean bill -of -lading in English for each shipment of cargo described in paragraph (1) of this <br />section to both the Contracting Officer (through the prime contractor in the case of <br />subcontractor bills -of -lading) and to the Division of National Cargo, Office of Market <br />Development, Maritime Administration, Washington, DC 20590. <br />3. To insert the substance of the provisions of this clause in all subcontracts issued pursuant <br />to this contract. <br />IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day first mentioned <br />above. <br />AGREEMENT <br />CALTRAIN GRADE CROSSING IMPROVEMENTS -SECTION 130 PROGRAM <br />
