<br />9. Permittee shall ensure that all of Permittee's active and reserve peace <br /> <br />officers who visit or use the Range pursuant to this Permit shall comply with all <br /> <br />Range safety rules established by City and all orders of City or its authorized <br /> <br />employees, officers, and agents, while on the Range. <br /> <br />10. Permittee shall clean up and dispose of all ammunition and other <br /> <br />materials used during Permittee's occupancy of the Range pursuant to this <br /> <br />Permit and Permittee shall leave the Range in at least the same clean and safe <br /> <br />condition as it was prior to usage by Permittee. <br /> <br />11. Permittee shall promptly report to City any unusual conditions in, or <br /> <br />occurrences within, the Range. <br /> <br />12. (a) Permittee agrees to indemnify, defend, and hold City, its Council, <br /> <br />boards, commissions, officers, agents, and employees harmless from any and all <br /> <br />claims, loss, liability, and damages in any way arising from the intentional or <br /> <br />negligent (whether active or passive) acts of Permittee or any of its officers, <br /> <br />employees, or agents in the use permitted hereunder. <br /> <br />(b) City and Permittee agree that liability for any and all claims, loss, <br /> <br />liability, and damages in any way arising from the concurrent active or passive <br /> <br />negligence of Permittee, its officers, employees or agents, and the active <br /> <br />negligence of the City, its officers, agents or employees shall be apportioned <br /> <br />according to the California law on comparative negligence. <br /> <br />Agmt-119 <br />DES:djk <br />F: Shared/Redwood/Council <br />03/10/98R <br />04/13/98R <br /> <br />3 <br />
