If Permittee so damages, interferes with, or obstructs the use of City-owned real property not included in this permit, Permittee shall bear all costs and expense thereby incurred by said City, agents, employees, contractors, or subcontractors, and Permittee shall reimburse said city, agents, employees, contractors or subcontractors for such cost and expense of City upon demand by City. Permittee further acknowledges and agrees that in the event of removal, damage, destruction or otherwise altering of the condition of said improvements b- third parties, Permittee shall reconstruct, reinstall, an(J repair said improvements at its own cost and expense upon request of City so to do. 7. OWNERSHIP OF IMPROVEMENTS. Permittee hereby acknowledges and agrees that once the improvements described in "Improvements," Exhibit "B," are made at the Fair Oaks Community Center, ownership and title to said improvements shall be vested in the City of Redwood City and Redwood City Child Development Center waives any and all rights to title or possession of said improvements. 8. RELEASE. Permittee shall be solely responsible and liable for all damages to persons or property, including injury or death of persons or loss of use of property, due directly or indirectly to Permittee's construction of the said improvements, and the use permitted hereunder, and shall promptly pay any just claim therefor and shall defend, indemnify and old the City of Redwood City, its Council, officers, boards, commissions, agents and employees, harmless from all suits, actions, damages, or claims to which said City may be subjected by reason of said construction and/or maintenance of said improvements or encroachment or use thereof permitted hereunder.
