<br />In consideration of allowing Permittee to install the <br /> <br />3. CONSIDERATION. <br /> <br />playground structure upon the Subject Premises, Permittee agrees to make such <br /> <br />improvements as are more particularly set forth in that document entitled <br /> <br />"Improvements," which is attached hereto as Exhibit "B" and incorporated herein by <br /> <br />this reference. Permittee agrees and consents to maintain the playground structure <br /> <br />and the Subject Premises in good order and repair and neat appearance. <br /> <br />4. IMPROVEMENT COMPLIANCE. All improvements permitted hereunder <br /> <br />shall be constructed in conformance with all applicable laws, statutes, ordinances, <br /> <br />rules and regulations (specific reference is hereby made to "City of Redwood City <br /> <br />Standard Specifications"), the approved site plan, and improvement plan specifying <br /> <br />the work to be done, said construction shall be expressly subject to the approval of <br /> <br />the City Engineer and the Director of Parks, Recreation and Community Services. <br /> <br />The improvement plan shall specify the work to be done and all other work, <br /> <br />improvements or appurtenances required and/or deemed necessary by the City <br /> <br />Engineer and the Director of Parks, Recreation and Community Services. <br /> <br />5. COST OF IMPROVEMENTS. The cost of the playground structure and the <br /> <br />cost of construction and installation of the improvements shall be at the sole cost and <br /> <br />expense of Permittee. <br /> <br />6. MANNER OF CONSTRUCTION. <br /> <br />Permittee shall carefully install said <br /> <br />improvements in such manner as not to damage, interfere with, or obstruct the use of <br /> <br />City-owned real property not included in this permit adjacent to and abutting the <br /> <br />Subject Premises. <br /> <br />Agmt-312 <br />F/sh/sh/RC/Council <br />11/15/99 <br />FXS:fs <br /> <br />2 <br />
