The Range shall be open and available for use by Permittee at such times as are mutually <br />agreed upon by both parties, hereof; provided, that City will endeavor to make the Range <br />available for use. However, it is expressly understood that exclusive use of the Range by <br />Patrol members will be subject to the prior approval of City, and at City's sole discretion. <br />Permittee shall designate a member to be in charge of each usage of the Range. <br /> <br />8. Permittee shall not permit more than 50 members (the "Roster") to occupy and/or use the <br />Range pursuant to and during the term of this permit. <br /> <br />9. Permittee shall maintain the Roster. It shall include the names, times, and dates of each <br />use of the Range by members pursuant to this Permit, and Permittee shall submit all Rosters <br />to the City for review no later than December 31, 1999. <br /> <br />10. This permit may be terminated by either party by giving at least thirty (30) day's written <br />notice to the other party before the termination date. <br /> <br />11. Upon termination of the Permit under paragraph 10, Permittee shall, within thirty (30) <br />days, submit to City the Roster required under paragraph 9 detailing usage by Permittee to <br />the date of termination. <br /> <br />12. Permittee shall ensure that all members who visit or use the Range pursuant to this <br />permit shall comply with all Range safety rules established by City and all orders of City or <br />its authorized employees, officers, and agents, while on the range. <br /> <br />13. Permittee shall clean up and dispose of all ammunition and other materials used during <br />Permittee's occupancy of the range pursuant to this Permit and Permittee shall leave the <br />Range in at least the same clean and safe condition as it was prior to usage by Permittee.. <br /> <br />14. Permittee shall promptly report City any unusual conditions in or occurrences within, <br />the Range. <br /> <br />15. City and Permittee affirm that they are equal opportunity employers, and shall comply <br />with applicable regulations governing equal employment opportunity. Neither City nor <br />Permittee shall discriminate, harass or allow harassment against any employee and/or the <br />employment of any person because of race, religious creed, color, national origin, ancestry, <br />physical handicap, medical condition, marital status, sex, age, denial for family and medical <br />care leave and denial of pregnancy disability leave, unless based upon a bona fide <br />occupational qualification pursuant to the Fair Employment and Housing Act (Government <br />code 12900 et seq.) And the applicable regulations promulgated thereunder (California Code <br />ofR3egulations, Title 2, 7285.0 et seq.), the applicable regulations of the Fair Employment <br />and Housing Commission implementing Government Code Section 12990 (a-f) set forth in <br />Chapter 5 of Division 4 of Title 2 ofthe California Code of Regulations in matters relating <br />
