However, it is expressly understood that exclusive use of the Range by <br />patrol members will be subject to the prior approval of City and at City's sole discretion. <br />Permittee shall designate a member to be in charge of each usage of the Range. <br /> <br />Permittee shall not permit more than fifty (50) members (the "Roster") to occupy and/or use <br />the Range pursuant to and during the term of this permit. <br /> <br />Permittee shall maintain the Roster. It shall include the names, times, and dates of each use <br />of the Range by members pursuant to this permit, and Permittee shall submit all Rosters to <br />the City for review no later than December 31,2001. <br /> <br />This permit may be terminated by either party by giving at least thirty (30) days written notice <br />to the other party before the termination date. <br /> <br />Upon termination of the permit under paragraph 10, Permittee shall, within thirty (30) days, <br />submit to the City the Roster required under paragraph 9 detailing usage by Permittee to the <br />date of termination. <br /> <br />Permittee shall ensure that all members who visit or use the Range pursuant to this permit <br />shall comply with all Range safety rules established by the City and all orders of the City or its <br />authorized employees, officers, and agents while on the Range. <br /> <br />Permittee shall clean up and dispose of all ammunition and other materials used during <br />Permittee's occupancy of the Range pursuant to this permit, and Permittee shall leave the <br />Range in at least the same clean and safe condition as it was prior to usage by Permittee. <br /> <br />Permittee shall promptly report to the City any unusual conditions in or occurrences within the <br />Range. <br /> <br />15. <br /> <br />City and Permittee affirm that they are equal opportunity employers, and shall comply with <br />applicable regulations governing equal employment opportunity. Neither the City nor <br />Permittee shall discriminate, harass or allow harassment against any employee and/or the <br />employment of any person because of race, religious creed, color, national origin, ancestry, <br />physical handicap, medical condition, marital status, sex, age, denial for family and medical <br />care leave, and denial of pregnancy disability leave, unless based upon a bona fide <br />occupational qualification pursuant to the Fair Employment and Housing Act (Government <br />Code 12900 et seq.). And the applicable regulations promulgated thereunder (California <br />Code of Regulations, Title 2, 7285.0 et seq.), the applicable regulations of the Fair <br />Employment and Housing Commission implementing Government Code Section 12990 (a-f) <br />set forth in Chapter 5 of Division 4 of Title 2 of the California Code of Regulations in matters <br />relating to reporting requirements and the development, implementation, and maintenance of <br />a non-discrimination program. <br /> <br />16. <br /> <br />Permittee shall be subject to examination and audit by authorized City employees and <br />retained independent auditors for a period of three (3) years after final payment under this <br /> <br />Agmt-410 <br />FX8:djk <br />F :/8 hared/Redwood/Co unci I <br />10/12/00 <br /> <br />2 <br />
