<br />EXHIBIT C <br /> <br />DESCRIPTION OF MITIGATION WORK <br /> <br />Capitalized terms used in this Exhibit C and not defined herein <br />shall have the meanings set forth in the License and <br />Indemnification Agreement to which this Exhibit C is attached. <br /> <br />Mitigation Work To Be Performed On The 7.44 Acres. Licensee <br />shall perform the following restoration and mitigation work <br />on the 7.44 Acres to restore the 7.44 Acres in order to <br />provide conditions suitable for wetland development in <br />accordance with the Mitigation Plan. <br /> <br />A. <br /> <br />1. <br /> <br />Restoration shall be accomplished through the creation <br />of cells which are separated from each other by berms <br />of from two (2) to three (3) feet in width and a <br />minimum of one foot above the finish grade of the <br />adjacent cells. The elevation within each cell shall <br />be laser-leveled to ensure that within each cell there <br />is a flat bottom of a single elevation. The depth of <br />excavation shall be determined by the material needed <br />to create the berms and to create a uniform elevation <br />within each cell. Grades may therefore differ among <br />cells but shall be constant within a cell and <br />surrounded by berms. Following compacting, the cells <br />shall be disked to create a microrelief in order to <br />create suitable conditions for natural revegetation. <br />The excavated soils materials shall be hauled off the <br />Property and properly disposed of on other real <br />property which is not owned by Licensor. Ponded or <br />saturated soils conditions should develop within these <br />cells leading to the development of wetlands <br />conditions. <br /> <br />2. <br /> <br />During installation and construction straw bales, silt <br />fence and other suitable barrier material shall be <br />placed around existing wetlands to prevent sediment <br />from entering these wetland areas. <br /> <br />3. <br /> <br />Maintenance activities during the five (5) year <br />monitoring period of restoration and mitigation shall <br />include weeding as necessary to ensure wetland plant <br />establishment and shall include any necessary <br />corrective action to prevent soil erosion during plant <br />establishment at the Property. Supplemented planting <br />and/or supplemental grading shall be performed as <br />necessary. <br /> <br />E:\RE\70140\O62\LICENSE4.WPD <br />
