<br />omissions of Licensor. The provisions of this Section 4.6 shall <br />cease to be applicable to Ryland from and after the date the <br />Notice of Completion (as defined in Section 5.1 below) is <br />recorded with the San Mateo County Recorder. <br /> <br />4.7 Limitations on Use. Licensees acknowledge and <br />agree that the license granted under this Agreement is granted <br />for the sole and exclusive purpose of allowing Licensees to <br />perform and maintain the Mitigation Work on the Property in <br />accordance with the provisions of this Agreement. Neither <br />Licensees nor any of the Licensee Group shall use the Property <br />for any other purpose whatsoever, including, without limitation, <br />to dispose of any materials, equipment, debris or supplies or to <br />construct any improvements whatsoever, other than as specifically <br />set forth or contemplated in this Agreement. <br /> <br />4.8 Maintenance of Drainage. Licensees and Licensees' <br />Contractors shall install and maintain the Mitigation Work on the <br />Property in such a manner so as not to interfere with drainage on <br />areas of Area 1-2 not within the boundaries of the Property and <br />so as not to interfere with Licensor's activities at the Project <br />or interfere with other real property owned by Licensor, <br />including, without limitation, maintaining existing storm <br />drainage swales or channels and avoiding depressions, holes and <br />ponding on areas of Area 1-2 not within the boundaries of the <br />Property. <br /> <br />5. Post Completion Covenants. The grant of the license <br />pursuant to Section 1 of this Agreement and Licensees' right to <br />enter upon the Property to perform the Mitigation Work is subject <br />to Licensees promptly satisfying all of the conditions subsequent <br />set forth in Sections 5.1 and 5.2 below following completion of <br />the Mitigation Work (collectively, the ~Conditions Subsequent"): <br /> <br />5.1 Notice of Completion. Within five (5) calendar <br />days following completion of the Mitigation Work or acceptance of <br />the Mitigation Work by the City Council, as appropriate, <br />Licensees shall both (i) provide written notice of such <br />completion to Licensor and (ii) complete and record with the San <br />Mateo County Recorder a notice of completion with respect to the <br />Mitigation Work, as applicable, which notice of completion shall <br />comply in all respects with the requirements of California Civil <br />Code Section 3093.
