<br />ORIGINAL <br /> <br />DES:djk <br /> <br />122/94 <br /> <br />(023/63) <br /> <br />A G R E E MEN T <br /> <br />--------- <br /> <br />SPECIAL LEGAL SERVICES - <br /> <br />REDWOOD SHORES LEVEE MAINTENANCE PROJECT <br /> <br />THIS <br /> <br />AGREEMENT, <br /> <br />made <br /> <br />and entered <br /> <br />into <br /> <br />this <br /> <br />36~ day of <br /> <br />~~~ <br /> <br />1994, <br /> <br />by <br /> <br />and <br /> <br />between <br /> <br />the <br /> <br />CITY <br /> <br />OF <br /> <br />REDWOOD <br /> <br />CITY, <br /> <br />a <br /> <br />municipal <br /> <br />corporation <br /> <br />of <br /> <br />the <br /> <br />State <br /> <br />of <br /> <br />California, <br /> <br />("City") , <br /> <br />and <br /> <br />WASHBURN, <br /> <br />BRISCOE <br /> <br />& <br /> <br />McCARTHY, <br /> <br />a <br /> <br />professional <br /> <br />corporation, of San Francisco, California ("Attorney"); <br /> <br />WIT N E SSE T H : <br /> <br />WHEREAS, City requires special legal services to obtain the <br /> <br />various <br /> <br />permits <br /> <br />necessary <br /> <br />for <br /> <br />the <br /> <br />Redwood <br /> <br />Shores <br /> <br />Levee <br /> <br />Improvement Project in the City of Redwood City (the "Project"); <br /> <br />and <br /> <br />WHEREAS, <br /> <br />Attorney <br /> <br />represents <br /> <br />that <br /> <br />it <br /> <br />possesses <br /> <br />the <br /> <br />experience, and is qualified, to perform the aforesaid services <br /> <br />for the Project; <br /> <br />NOW, THEREFORE, the parties agree as follows: <br /> <br />1. ATTORNEY'S SERVICES. <br />consulting and related services <br />Proposal dated August 23, 1994, <br /> <br />Attorney <br /> <br />shall <br /> <br />perform <br /> <br />legal <br /> <br />described <br /> <br />Attorney's <br /> <br />Letter <br /> <br />marked <br /> <br />Exhibit <br /> <br />"A" <br /> <br />hereof, <br /> <br />attached hereto and by this reference incorporated herein. <br /> <br />2. <br /> <br />COMPENSATION; EXPENSES; PAYMENT. City shall compensate <br /> <br />Attorney for all services performed by Attorney hereunder in an <br /> <br />amount based <br /> <br />upon Attorney' s <br /> <br />hourly <br /> <br />rates <br /> <br />that <br /> <br />are <br /> <br />currently <br /> <br />prevailing during the time of the performance of said services. <br />
