Conditions as Necessary: (continued) <br /> <br />(d) Relevant information that you or your consultants have developed on the history of the site, with respect <br />to past diking, ditching, draining, filling, dredging and land use (e.g., farming) activities. <br /> <br />(e) Relevant information that you or your consultants have developed on the physical nature of the soils (e.g., <br />gravel, sand, silt, clay, construction rubble, garbage, etc.) at the site. <br /> <br />(t) Relevant information that you or your consultants have developed on the botanical and zoological aspects <br />of the site. <br /> <br />(g) Relevant information that you or your consultants have developed, or are in the process of preparing, for <br />other regulatory actions that may be relevant to fulfilling requirements of the Clean Water Act (i.e., <br />NPDES permit). <br /> <br />(h) Copies of project description materials and general design drawings. <br /> <br />10. Other: <br /> <br />H&A, Inc. is being retained by Attorney and Northport Business Park (Client) for the dominant purpose of <br />assisting the law firm of Attorney in rendering legal services to Client in matters regarding the subject facilities. <br />All information transmitted between H&A, Inc., Client and Attorney is intended to be kept confidential and to <br />be protected by the attorney-client privilege and attorney work product privilege. H&A, Inc. will be available <br />to consult with Attorney generally regarding any possible investigation or litigation or administrative action that <br />may result therefrom.
