7.A. - Page 2 <br />improvements designed to reduce the additional traffic resulting from the <br />development. <br />On October 22, 2007, the City Council enacted the Parks Impact Fee Ordinance (Article <br />XVI of Chapter 18 of the Municipal Code) establishing the parks impact fee. These fees <br />are intended to augment recreational opportunities through the improvement of parks in <br />order to compensate for increased demand for City facilities and services brought about <br />by new development and the associated increase in population. <br />Most recently, on December 7, 2015, the City Council adopted the Affordable Housing <br />Impact Fee Ordinance adding Article XVII (Affordable Housing Impact Fee) to Chapter <br />18 of the Municipal Code. The affordable housing impact fees provide revenue to create <br />housing affordable to extremely low income, very low income, lower income, and <br />moderate income households in the City, consistent with the goals and policies <br />contained in the City's Housing Element. <br />The Government Code Section 66001(d)(1) requires that the fifth fiscal year following <br />the first deposit into the account or fund, and every five years thereafter, the local <br />agency shall make all of the following findings with respect to that portion of the account <br />or fund remaining unexpended, whether committed or uncommitted: <br />1. Identify the purpose to which the fee is to be put. <br />2. Demonstrate a reasonable relationship between the fee and the purpose for <br />which it is charged. <br />3. Identify all sources and amounts of funding anticipated to complete financing in <br />incomplete improvements. <br />4. Designate the approximate dates on which the funding is expected to be <br />deposited into the appropriate account or fund. <br />Staff recommends that the City make these findings on an annual basis, and the basis <br />for the findings is included in the Development Impact Fees Report. Council may make <br />these findings by adopting the attached resolution. <br />In addition, pursuant to California Government Code Section 66006(b)(1), local <br />agencies are to make available to the public and review certain information related <br />to development impact fees. The City plans to make this information available <br />annually. This year's report was made available to the public beginning December 22, <br />2017 and public notice of the availability was published in the newspaper. Additionally, <br />notice was mailed to all interested parties per Government Code (66006(b)(2)). City <br />staff has compiled this information in Attachment 2, the Development Impact Fees <br />Report, which responds to the following Government Code requirements: <br />1. A brief description of the type of fee in the account or fund <br />2. The amount of the fee <br />3. The beginning and ending balance of the account or fund <br />4. The amount of the fees collected and the interest earned <br />5. An identification of each public improvement on which fees were expended <br />
