Code § 27383. <br />IMPROVEMENT AGREEMENT <br />1409 El Camino Real <br />THIS I PROVEMENT AGREEMENT ("Agreement") is made and entered into on this <br />day oft 1 t1MA v%&Ce' 20a ("Effective Date") by and between GS Diller Subsidiary, <br />LLC, a Delaware limited liability company ("Developer"), and the CITY OF REDWOOD <br />CITY, a charter city and California municipal corporation ("City") with reference to the <br />following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 1.64 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br />B. On April 3'd, 2017, the City Council of the City of Redwood City adopted, among other <br />approvals, Resolution No. 15575, approving the Vesting Tentative Parcel Map for the 1409 EI Camino <br />Real ("Project"), prepared by Talus, Inc. and dated December 8", 2016 ("Tentative Map"), subject to <br />certain conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the Parcel Map ("Parcel Map"), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D. Developer has submitted the Parcel Map and applied to City for Parcel Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled Improvement <br />Plans for 1409 El Camino Real, prepared by Talus, Inc. and dated NOV. 10 , 2011 (the "Improvement <br />Plans"), which, in addition to other improvements, provide for certain on-site public improvements <br />consisting of street and street light improvements, storm drain systems, domestic water systems and <br />sanitary sewer systems for the Project (collectively, "Improvements"). <br />F.
