k. "Premises": the entire area owned and utilized by the business establishment that <br /> provides Shopping Carts for use by customers, including any parking lot or other off- <br /> street area provided by or for an Owner for use by a customer for parking an <br /> automobile or other vehicle. <br /> <br />I. "Participating Owner": an Owner who or which has entered into an agreement with <br /> the City to participate in City's Shopping Cart Retrieval Program. <br /> <br />m."Service Area": all streets (including sidewalks, parking strips, median strips, and <br /> extensions of street easements to abutting property lines), walkways, roads, paths, <br /> other City-owned or used easements, City-owned lands and appurtenances, and <br /> the outdoor common area of any building, business premises, apartment building or <br /> complex, or other premises or portion thereof which is adjacent to public property, <br /> and open to the public, within the corporate limits of City and subject to the election <br /> of a Participating Owner, all streets (including sidewalks, parking strips, median <br /> strips, and extensions of street easements to abutting property lines), walkways, <br /> roads, paths, other publicly-owned or used easements, publicly-owned lands and <br /> appurtenances, and the outdoor common area of any building, business premises, <br /> apartment building or complex, or other premises or portion thereof which is <br /> adjacent to public property, and open to the public as shown on Exhibit "A" hereof, <br /> attached hereto, and incorporated by reference. <br /> <br />n. "Shopping Cart": a basket which is mounted on wheels or a similar device generally <br /> used in a retail establishment by a customer for the purpose of transporting goods of <br /> any kind, including a Laundry Cart. <br /> <br />o. "Shopping Cart Retrieval Program": City's program for retrieval of Abandoned <br /> Shopping Carts under which Participating Owners contract with City for Shopping <br /> Cart retrieval services and City, in turn, contracts with an enterprise in the business <br /> of Shopping Cart retrieval, the costs of which are borne by the Participating Owner. <br /> <br /> 2. Retrieval Services. Contractor shall provide the following services: <br /> <br />(a)General. Contractor's general scope of services includes locating, identifying, and <br /> retrieving Abandoned Shopping Carts from and within the Service Area. <br /> Participating owner carts may be retrieved from out of the service area, if they are <br /> within 300 feet of the City limits. Abandoned Shopping Carts which are identified as <br /> belonging to Participating Owners shall be returned to the Participating Owners by <br /> Contractor; provided, that only Shopping Carts belonging to Participating Owners <br /> who expressly have elected to have Shopping Carts retrieved from that portion of <br /> the Service Area outside City's corporate limits as shown on Exhibit "A" shall be <br /> retrieved therefrom. Abandoned Shopping Carts, which are not so identified, shall <br /> be delivered to the Center.
