9, On-Site PriYatel¥ Owned ImproYemenl$ <br /> <br />Owner shall construct at OwneP sole cost all on-site improvements, including but not <br />limited to, on-site parking lots, roadways, utility improvements, and similar <br />improvements, which are not offered for dedication to City for ownership, operation or <br />maintenance (the "Private On-Site Improvements"). Owner shall conStruct the Private <br />On-Site Improvements according to the standards contained in the Building Regulations <br />in effect at the time of the issuance of the applicable building permit and applied by the <br />Community Development Department of City to private improvements that are not the <br />subject of a planned development permit. <br /> <br /> 10. Parking. <br /> <br />The on-site parking requirement is one (1) parking space per 300 square feet of GBFA, <br /> <br />for a total of on-site parking spaces of 25. <br /> <br /> 11. Permitted Delay. <br /> <br />Owner is not in default under this Agreement and has complied in good faith with this <br />Agreement where any delay by Owner in the performance of any term or condition of <br />this Agreement is the result of war, insurrection, strikes, walk-outs, riots, floods, <br />earthquakes, fires, casualties, acts of God, governmental restrictions imposed or <br />mandated by other governmental entities, enactment of conflicting laws, judicial <br />decisions, institution of litigation by parties unaffiliated with Owner, or any cause which <br />is not within the reasonable control of Owner. <br /> <br /> -9- <br /> Agmb450113001 <br /> FXS:4r <br /> 02/04/02R, 02/12/02R <br /> <br /> <br />
