Mr. <br />Opfer noted that this parcel was his parent's only source of income and he <br />wished to proceed with development. <br /> <br />Chairman Garcia asked what fees the developer would have paid without the DA. <br />Staff indicated that the developer would have been required to simply complete <br />the undergrounding along Middlefield Road; and that the additional <br />improvements along Willow were only required because of the DA. <br /> <br />Commissioner Paulson said she felt the City's estimates of cost were clear and <br />that she was in favor of recommending the item to the Council. Commissioners <br />McCoy and Radcliffe agreed with Commissioner Paulson. <br /> <br />M/S: McCoylPlulle: To close the public hearing. Approved unanimously. <br /> <br />Commissioner Seybert noted that as a percentage of the total project cost, the in- <br />lieu fees were reasonable. <br /> <br />Commissioner Piulle noted that the development approvals must include <br />requirements for 'cultural resource management' because this site may well <br />contain items of historical or archeological significance. <br /> <br />Commissioner Faust expressed annoyance at the developer for the receipt of <br />information at the last minute. Nevertheless, she indicated that she would vote to <br />recommend the DA to Council as presented. <br /> <br />Attorney Sorba noted that the developer's attorney had asked for clarification <br />that, if the developer does not proceed with the project, they will not have to pay <br />the fees. Further, if they get their building permit and pay their fee, but then do <br />not proceed with any site development, the fee will likewise be refunded. If the <br />developer begins work on foundations, however, the fees wilt no longer be <br />refundable. <br /> <br />M/S: McCoylPaulson: To recommend the DA to City Council as drafted by staff, <br />with the clarification offered by the City Attorney and with the further requirement <br />that the developer be furnished with a copy of the City's Cultural Resource <br />Management Plan.
