To the HOn~ble!! <br /> <br />February 25, 2002 <br /> <br />Subject <br />Approve Resolution of Intention authorizing re-classification of Fire Prevention Officers to the Safety <br />member classification, amending our contract with the Public Employees Retirement System <br />(CalPers) based on Government Code Section 20434. <br /> <br />Recommendation <br />That the City Council adopt the resolution of intention to amend the current contract with the Public <br />Employees Retirement system (CalPers) to provide for Government Code Section 20434, <br />"Reclassification to Safety member" status as per the request of those currently designated as Fire <br />Prevention officers. <br /> <br />Background <br />In January, 1988, Assembly Bill 839, amendment to Government Code Section 20021 (Chapter <br />1411, Statues of 1987), allowed for Fire Prevention Officers and Fire Marshalls hired between <br />January 1, 1988 and October 1, 1989, to be re-classified as Fire Safety members, qualifying them to <br />the retirement pension for Safety members. In 1988 there were two employees in the City that <br />qualified for the re-classification. As such these employees were re-classified as eligible for the .Fire <br />Safety Retirement plan with the California Public Employees Retirement System (CalPers). However, <br />employees hired after this date would not be eligible for the Safety member status unless the City <br />amended its contract with the California Public Employees Retirement system (CalPers). <br /> <br />During the most recently concluded negotiations with the Service Employees International Union, <br />(SEIU), the City agreed to provide the change to "Safety" status under the California Public <br />Employees Retirement System, Section 20434 for the two remaining Fire Prevention Officers. The <br />amendment to our contract with the Public Employees Retirement system (CalPers) will enable these <br />two employees to eligibility for the Fire Safety members Retirement Plan. <br /> <br />Fiscal Impact <br />The actual cost of this retirement benefit for the Fire Prevention Officers is a total of $7,552.00 <br />annually. The first year cost was part of the SEIU negotiated contract agreement.
