Franchise Fees, recycling surcharge, and overhead included in payments on <br /> BDBS subcontract; <br /> .:. Fines; <br /> .:. Liquidated damages; <br /> .:. Income taxes; <br /> .:. Charitable or political donations; <br /> .:. Long-term rental or lease charges for collection vehicles which are greater than <br /> the cost of acquisition; <br /> .:. Attorney's fees as described in the Agreement related to suits by Contractor <br /> against SBWMA or its Member Agencies; <br /> .:. Goodwill; <br /> .:. Fifty percent (50%) of District personnel expense <br /> .:. Personnel and Equipment greater than those included in Contractor's prior year <br /> application as adjusted by SBWMA and/ or Member Agency unless approved <br /> in advance by the SBWMA and/ or Member Agency. <br />B. Reasonable and Necessary Costs <br /> Actual Contractor expenses should be reduced by Contractor to exclude and/ or <br /> reduce any costs, which were not reasonably and necessarily incurred in the <br /> performance of the services provided in accordance with the Agreement. For <br /> example, costs for personnel during the implementation of new services greater <br /> than the expense assumed in Contractor's Projected Cost may be disallowed. <br />C. Other Expenses Allowed/Disallowed in Contractor Compensation <br /> Additional expenses, not set forth in the Agreement, may be allowed or disallowed <br /> in the Contractor compensation such as when SBWMA directs the Contractor to <br /> perform additional services or when Contractor incurs additional costs for which it <br /> is solely responsible such as liquidated damages. <br /> SBWMA Compensation Adjustment Guidelines June 6, 2000 <br /> PAGE 9 <br />
