1 2 B. Insolvency or Bankruptcy. If Contractor becomes insolvent, 3 unable, or unwilling to pay its debts, or upon listing of an order for relief in favor of 4 Contractor in a bankruptcy proceeding. 5 6 C. Failure to Maintain Coverage. If Contractor fails to provide or 7 maintain in full force and effect the Workers' Compensation, liability, or 8 indemnification coverage as required by this Agreement. 9 10 D. Violations of Regulation. If Contractor violates any orders or 11 filings of any regulatory body having authority over Contractor relative to this 12 Agreement, provided that Contractor may contest any such orders or filings by 13 appropriate proceedings conducted in good faith, in which case no breach of this 14 Agreement shall be deemed to have occurred. 15 16 E. Failure to Perform. If Contractor ceases to provide Collection, 17 processing or Recycling services as required under this Agreement for a period of two 18 (2) consecutive days or more, for any reason within the control of Contractor, including 19 labor disputes. 20 21 F. Failure to Pay. If Contractor fails to make any payments required 22 under this Agreement and! or Refuses to provide Agency with required information, 23 reports, and! or records in a timely manner as provided for in the Agreement. 24 25 G. Acts or Omissions. Any other act or omission by Contractor which 26 violates the terms, conditions, or requirements of this Agreement, the Act of 1989, as it 27 may be amended from time to time, or any law, statute, ordinance, order, directive, 28 rule, or regulation issued thereunder and which is not corrected or remedied within the 29 time set in the written notice of the violation or, if Contractor cannot reasonably correct 30 or remedy the breach within the time set forth in such notice, if Contractor should fail to 31 commence to correct or remedy such violation within the time set forth in such notice 32 and diligently effect such correction or remedy thereafter. 33 34 H. False or Misleading Statements. Any representation or disclosure 35 made to Agency by Contractor in connection with or as an inducement to entering into 36 this Agreement, or any future amendment to this Agreement, which proves to be false 37 or misleading in any material respect as of the time such representation or disclosure is 38 made, whether or not any such representation or disclosure appears as part of this 39 Agreement. 40 41 I. Attachment.
