<br /> 1 a) For each failure to commence service to a new service <br /> 2 recipient account within seven (7) days after order, which exceed five (5) such failures <br /> 3 annually: $150.00 <br /> 4 <br /> 5 b) For each failure to Collect Solid Waste, which has <br /> 6 been properly set out for Collection, from an established service recipient account on <br /> 7 the scheduled Collection day and not Collected within the period described in this <br /> 8 Agreement which exceeds fifteen (15) such failures annually: $150.00 <br /> 9 <br /> 10 c) For each failure to Collect Solid Waste, which has <br /> 11 been properly set out for Collection, from the same service recipient on two (2) <br /> 12 consecutive scheduled pickup days: $150.00 <br /> 13 <br /> 14 d) For each failure to prepare for or properly conduct <br /> 15 special collections as described in Section 4.07 including advertising and press releases: <br /> 16 $250.00 <br /> 17 <br /> 18 e) For each failure to perform and submit billing <br /> 19 reviews: $250.00 <br /> 20 <br /> 21 2. Collection Quality. <br /> 22 <br /> 23 a) For each occurrence of damage to private property <br /> 24 which exceeds seven (7) such occurrences annually: $250.00 <br /> 25 <br /> 26 b) For each occurrence of failure to properly return <br /> 27 empty Containers to avoid pedestrian or vehicular traffic impediments or to place cans <br /> 28 upright with lids secured (in areas where service recipients own their containers, if <br /> 29 applicable) which exceeds ten (10) such occurrences annually: $150.00 <br /> 30 <br /> 31 c) For each occurrence of excessive noise or <br /> 32 discourteous behavior: $250.00 <br /> 33 <br /> 34 d) For each failure to clean up Solid Waste spilled by <br /> 35 Contractor from Solid Waste, Recyclable Materials, Commercial ()rganic Materials and <br /> 36 Plant Materials Containers which exceeds fifteen (15) such failures annually: $150.00 <br /> 37 <br /> 38 e) For each occurrence of Collecting Solid Waste, <br /> 39 Recyclable Materials, Commercial ()rganic Materials and Plant Materials during <br /> 40 unauthorized hours which exceeds ten (10) such occurrences annually: $250.00 <br /> 41 <br /> 42 f) For each year that Contractor fails to meet the annual <br /> 43 diversion levels described in Section 4.05: $50,000 in total for the SBWMA Service Area. <br /> 44 <br /> 45 <br /> Atty j Agrj2005.022 <br /> 060205 -60- <br />
