<br /> solid waste transfer, recyclable materials and plant material processing, and marketing <br /> services. <br /> The Contractor has submitted Projected Costs (corresponding to the services, terms and <br /> conditions described in this Agreement) to the SBWMA dated March 1, 2000, and the <br /> Member Agencies elected to enter into this Agreement based on this Agreement and those <br /> Projected Costs. All future compensation adjustments are to be based in part on the <br /> Contractor's prior year Projected Costs. In order to ensure that the Contractor performed <br /> in accordance with the operational assumption upon which the prior year Projected Costs <br /> are based, the Projected Costs and Operation Assumptions were incorporated, into the <br /> Agreement. These are an integral part of the compensation adjustment process since they <br /> provide the detailed specifications behind the compensation established for the prior year. <br /> The Member Agencies have delegated the administration of these procedures to the <br /> SBWMA but may, upon written notice to SBWMA and Contractor, elect to perform these <br /> procedures independently from the SBWMA through the use of the Member Agency's <br /> own staff or a third party. <br /> DEFINITIONS <br /> Unless the context otherwise requires, capitalized terms used in these Guidelines, also <br /> referred to as Exhibit D, will have the meaning specified in Exhibit A to the Solid Waste, <br /> Recyclable Materials and Plant Material Collection Services Franchise Agreement. In <br /> addition, the following are used to define rate-setting periods. <br /> Rate Year - January 1 to December 31. <br /> Fiscal Year - The Contractor's fiscal year. <br /> Prior Year - The year prior to the year of submission. For example, if the Application is <br /> being submitted in 2000, the Prior Year is January 1, 1999 to December 31,1999. <br /> Current Year - The year the compensation application is submitted for review. For <br /> example, if the submission year is 2000, the Current Year is January 1, 2000 to <br /> December 31, 2000. <br /> Rate Year - The Rate Year is the year upon which projections are made to determine <br /> contractor compensation and follows the Current Year.
