iREPORT TO the Honorable Mayor and City Council
From the City Manager

July 1,2002

Subject
Approval of Landscape Maintenance Agreement - Pacific Shores Development, LLC, a
Delaware limited partnership (PSD) Pacific Shores / Seaport Boulevard

Recommendation
Approve the Landscape Maintenance Agreement with Pacific Shores Development,
LLC, a Delaware limited Partnership (PSD) in lieu of the creation or assumption of the
Seaport Boulevard Landscape Maintenance District, for the maintenance of the
landscape improvements along Seaport Boulevard as depicted on the attached map.

Background
On July 5, 2000, by Resolution No. 13918, the City Council approved the Agreement for
Construction of Improvements on Seaport Boulevard, which was recorded as Document
No. 2000-125056 on October 5, 2000, in the Hall of Records of San Mateo County. As
part of this Agreement, the City Council adopted a Resolution of Intention to form a
Landscape Maintenance District. PSD has requested to maintain the landscaping in
lieu of the creation of a Landscape Maintenance District.

Fiscal Impacts
As part of the Agreement for Construction of Improvements along Seaport Boulevard,
once a Landscape Maintenance District is established, assessments will be levied
against PSD for maintenance of the landscaping along Seaport Boulevard. Since PSD
has agreed to maintain the landscaping until establishment of a District, there are no
fiscal impacts to the City by this action.

~B-~ian Le-e~ F B~f~ce Liedst'ranO ~~Ed Everett
Senior Civil Engineer Community Development Services Director City Manager

BL:ss
s/library/reports/Brian/Landscape Maintenance Agreement_PSD
