7,/-Z5- <br /> <br /> E. CMl shall pay on behalf of City, from City's trust funds as set forth in <br />Section X, those sums that City should reasonably pay under the California Workers' <br />Compensation laws. Any settlement in excess of the mutually agreed limit set forth in <br />the original proposal, must be first approved by City. <br /> <br /> F. After consultation with City, CMl shall refer to attorneys selected by City all <br />matters in which an employee of City files an Application with the California Workers' <br />Compensation Appeals Board. It is understood and agreed that even in the event <br />where an application has been filed, a substantial effort will be made by CMl to resolve <br />the claim prior to assigning the matter to City's legal counsel. <br /> <br /> G. After consultation and approval by City, CMl shall select such medical <br />doctors, psychiatrists, psychologists, medical managers, etc, schedule medical <br />appointments, and other services as is reasonably necessary in the management of <br />workers' compensation cases. <br /> <br /> H. On behalf of City, CMl shall proceed against responsible persons, <br />agencies and/or their agent in subrogation actions in order to recover losses suffered by <br />City. <br /> <br /> I. On behalf of City, CMl shall pay, from the trust funds identified in Section <br /> <br />X, herein, all "allocated ;r~SS expenses" which are defined to include all fees for <br />attorneys, witnesses, court reporters, photocopies, fee schedule reviews, process <br />servers, independent investigators, any court of Workers' Compensation Appeals <br />Board, for depositions, surveillance, or the necessary engagement of personnel, <br />independent of CMl in the handling of any claim subject to this Agreement. <br /> <br />F:ATTY/AGR/AGR.048 4 <br />061902 <br /> <br /> <br />
