<br />.4: ,.r. lJ:r <br /> <br />any governmental body having jurisdiction. If Tenant shall fail to comply with the <br />provisions of this Section 4.3.4 within five (5) days after written notice by <br /> <br />landlord, or such shorter time as may be required by Laws or in order to <br />minimize any hazard to persons or property, landlord may (but shall not be <br /> <br />obligated to) arrange for such compliance directly or as Tenant's agent through <br />contractors or other parties selected by Landlord, at Tenant's expense (without <br /> <br />limiting landlord's other remedies under this lease or applicable laws). <br /> <br />4.3.5 Casualty Damage. If any Hazardous Material is released, <br />discharged, or disposed of on or about the Property and such release, discharge, <br /> <br />or disposal is not caused by Tenant or other occupants of the Premises, or their <br />employees, agents, or contractors, such release, discharge, or disposal shall be <br /> <br />deemed casualty damage under Article 6 to the extent that the Premises or the <br />common areas serving the Premises are affected thereby; in such case, Landlord <br /> <br />and Tenant shall have the obligations and rights respecting such casualty <br />damage provided under Article 6 of this Lease. <br /> <br />4.3.6 Freon. Tenant shall not install any Freon-containing <br />systems or equipment including, but not limited to, refrigerators, freezers, <br /> <br />supplemental HVAC systems or self-contained air conditioners without <br />landlord's prior approval which landlord may withhold in its sole discretion. <br /> <br />Landlord shall have the option, at Tenant's sole cost and expense, to have <br />Landlord's engineer inspect for defects and proper installation the freon- <br /> <br />containing equipment and/or systems which Tenant proposes to install in the <br />Premises. Whether Tenant's freon-containing equipment and/or systems is (are) <br /> <br />defective and is (are) properly installed shall be determined at the sole discretion <br />of Landlord's engineer. In the event that Tenant wishes to install any freon- <br /> <br />containing equipment and/or systems, Tenant shall obtain all required user <br />
