Notwithstanding anything to the contrary in Sections 5.8 and 5.9, the Parties release each other from any claims either party ("Injured Party") has against the other, but only to the extent the claim or liability is covered by the Injured Party's insurance or the insurance the Injured Party is required to carry under this Article 5, whichever is greater. 5.11 Limitation Liability Upon Transfer. In case Landlord or any successor owner of the Property or the Building shall conveyor otherwise dispose of any portion thereof to another person or entity ("Person") (and nothing herein shall be construed to restrict or prevent such conveyance or disposition), such other person shall thereupon be and become landlord hereunder and shall assume and be liable for all obligations of this Lease to be performed by landlord which first arise after the date of conveyance, including the return of any Security Deposit; and, provided the successor owner shall have assumed such obligations, in writing, Tenant shall attorn to such other Person, and Landlord or such successor owner shall, from and after the date of conveyance, be free of all liabilities and obligations hereunder not then incurred. 5.12 Limitations on Landlord's Liability. The liability of landlord to Tenant for any default by Landlord under this Lease or arising in connection herewith or with landlord's operation, management, leasing, repair, renovation, alteration, or any other matter relating to the Property or the Premises, shall be limited to the interest of Landlord in the Property (and the proceeds thereof) unless the interest in the Property is less than insurance that may cover the claim, in which case, the amount of insurance
