U10144-01 <br />PROPERTY LOCATION: 1041 Middlefield Road <br /> <br />Your Use Permit application to allow a full service restaurant with exterior seating, including the sale of <br />liquor and other alcoholic beverages on property located at 1041 Middlefield Road was heard at the Zoning <br />Administrator hearing of January 9, 2002. <br /> <br />The above application was approved with the following conditions: <br /> <br />FINDINGS: <br /> <br />1. The proposed restaurant use is considered to be compatible with the purposes of the "CBR" Central <br /> Business Retail Zoning District. The sale of alcohol is allowed because it is in conjunction with the <br /> restaurant operation. The outdoor use ids compatible with the sidewalk Caf6 program in conjunction <br /> with the Broadway Hall Ordinance which was adopted by the City in order to increase the pedestrian <br /> character of the Downtown area. <br />2. The proposed operation is expected o remain in full compliance with all local, County, State and <br /> Federal regulations at all times. <br />3. The physical improvements proposed by the applicant are considered temporary in nature and <br /> revocable upon notification by the City. All outside tables and Chairs shall be stacked against the <br /> building on a daily basis at the end of each work day. <br /> <br />CONDiTiONS: <br /> <br />1. This Use Permit for allowing outside tables and chairs and planters is subject to review and <br /> modification by the City in the event that the City determines that an improved layout or reduced <br /> scheme is preferable. This permit is revocable in the event that the City determines that the proposed <br /> use is not in compliance or detrimental to the surrounding area. <br />2. The applicant shall'obtain and abide by a companion License Aoreement prepared by the City prior <br /> to the installation of tables and chairs in the public plaza (see attached). <br />3.
