January 28, 2002 <br /> <br />Subject <br />Approval of Agreement - Temporary Construction Easement - Friendly Acres Area <br />Storm Drain Improvements Project - Phase II - Engineering File No. 801-04 <br /> <br />Recommendation <br />Approve an agreement for a temporary construction easement with Harbor Village LLC <br />for the construction of the Friendly Acres Area Storm Drain Improvements Project - <br />Phase II. <br /> <br />Background <br />On June 11, 2001, the City Council awarded a contract to McGuire & Hester of <br />Oakland, California, to construct Phase II of the Friendly Acres Area Storm Drainage <br />improvement Project. Construction began on September 17, 2001. On November 14, <br />2001, the 66-inch storm drainage pipe was successfully installed from 5th <br />Avenue/Rolison Road to East Bayshore Road by crossing under Highway 101 using the <br />Micro-tunneling technique. <br /> <br />On November 17, 2001, the Contractor informed the City that the Micro-tunneling <br />process (for some undetermined reason) had lost the precision control by six inches. A <br />Specialist from out of State was hired by the Contractor to evaluate the situation. It was <br />concluded that, by continuing to increase the jacking force, or making any attempt to <br />correct the six inch offset, may damage the pipes already installed under Highway 101. <br />Therefore, staff agreed to stop the Micro-tunneling process and approved the <br />emergency retrieving process to retrieve the jacking head and electronic devices. The <br />reason for the six-inch offset is still under investigation. <br /> <br />In order to restart the Micro-tunneling process to complete the remaining 200 feet of the <br />66-inch storm drainage pipe within Harbor Village Mobil Home property, a temporary <br />construction easement, in addition to the existing storm drainage easement, is required. <br /> <br />On January 8, 2002, City staff members and the Owner of Harbor Village LLC reached <br />an agreement on the conditions for allowing the City access for a temporary <br />construction easement. The primary concern was the schedule to complete all of the <br />work within the mobile home park. The work will be completed by March 4, 2002. <br /> <br />A complete copy of the Agreement is available for review in the office of the City Clerk. <br /> <br />Alternative <br />There is no viable alternative to complete this portion of the storm drain project. <br /> <br /> <br />
