<br />XCU may be deleted when not applicable to operations <br /> <br />performed by the Contractor or his subcontractors. <br /> <br />5. <br /> <br />Umbrella Policy At the option of the Contractor, limits may be less <br /> <br />than required, with an Umbrella Policy providing the additional limits needed. <br /> <br />This form of insurance will be acceptable provided that the Primary and Umbrella <br /> <br />Policies both provide the insurance coverages herein required. <br /> <br />b. <br /> <br />Workers' Compen~ation and Employers Liability Insurance. In <br /> <br />accordance with the provisions of Article 5, Chapter 1, Part 7, Division 2 (Commencing <br /> <br />with Section 1860) and Chapter 4, Part 1, Division 4 (commencing with Section 3700) of <br /> <br />the Labor Code of the State of California, the Contractor is required to secure the <br /> <br />payment of compensation to his employees and to that purpose obtain and keep in <br /> <br />effect adequate Worker's Compensation Insurance. <br /> <br />If the Contractor, in the sole <br /> <br />discretion of the City, satisfies the City of the responsibility and capacity under the <br /> <br />applicable Workers' Compensation Laws, if any, to act as a self-insurer, he may so act, <br /> <br />and in such case, the insurance required by this paragraph need not be provided. <br /> <br />The Contractor is advised of the provisions of Section 3700 of the Labor Code <br /> <br />which require every employer to be insured against liability for Workers' Compensation <br /> <br />or to undertake self-insurance in accordance with the provisions of that code, shall <br /> <br />comply with such provisions and have Employers' Liability limits of $1,000,000 per <br /> <br />accident before commencing the performance of the work of this Contract. <br /> <br />5 <br /> <br />Agmt-330 <br />FXS:djk <br />F: S harediRedwood/Counc il <br />03/09/00 <br />
