<br />Beginning in 1998-99, the maximum obligation of <br /> <br />County shall not exceed EIGHTY THOUSAND SEVEN HUNDRED THIRTY <br /> <br />DOLLARS ($80,730). <br /> <br />Thereafter, County may negotiate an annual <br /> <br />Cost of Living Adjustment (COLA). <br /> <br />The COLA would be based on the <br /> <br />Bay Area rate of inflation, program operating costs and available <br /> <br />County financial resources. <br /> <br />Any COLA is subject to the approval <br /> <br />of the Director of Health Services or her designee, and shall <br /> <br />not be binding on County unless so approved in writing. <br /> <br />Cities <br /> <br />shall contribute one hundred percent (100%) of the remaining cost <br /> <br />of the operation of the facility based on the following formula: <br /> <br />thirty-three percent (33%) use of facility in prior year, thirty- <br /> <br />three percent (33%) population, and thirty-three percent (33%) <br /> <br />number of liquor licenses of each city." <br /> <br />NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES that: <br /> <br />1. <br /> <br />These amendments are hereby incorporated and made a <br /> <br />part of the Original Agreement and subject to all provisions <br /> <br />therein. <br /> <br />2. <br /> <br />All provisions of the Original Agreement, including all <br /> <br />references to audit and fiscal management requirements unless <br /> <br />otherwise amended hereinabove, shall be binding on all the par- <br /> <br />ties hereto. <br /> <br />3. <br /> <br />All provisions of the Original Agreement, including all <br /> <br />monitoring and evaluation requirements, shall be applicable to <br /> <br />all amendments herein. <br /> <br />NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES that the <br /> <br />Original Agreement of September, 1991, be amended accordingly. <br /> <br />2 <br />
