<br />8, <br /> <br />A, <br /> <br />B. <br /> <br />9, <br /> <br />12/17/01 <br /> <br />representaÖve violates this Agreement and shall automatically terminate <br />this Agreement. <br /> <br />RECORDS <br /> <br />Contractor agrees to provide to Agency, City, to any Federal or <br />State department having monitoring or reviewing authority, to City's <br />authorized representatives and/or their appropriate audit agencies upon <br />reasonable notice, access to and the right to examine and audit all records <br />and documents necessary to determine compliance with relevant Federal, <br />State, and local statutes, rules and regulations, and this Agreement, and to <br />evaluate the quality, appropriateness and timeliness of services performed. <br /> <br />Contractor shall maintain and preserve all records relating to this <br />Agreement in its possession of any third party performing work related to <br />this Agreement for a period of three (3) years from the termination date of <br />this Agreement, or until audit findings, if any, are resolved, whichever is <br />greater. <br /> <br />COMPLIANCE WITH APPLICABLE LAWS <br /> <br />All services to be performed by Contractor pursuant to this Agreement <br />shall be performed in accordance with all applicable Federal, State, City <br />and Municipal laws, ordinances, regulations, including but not limited to <br />appropriate licensure, certification regulations, and provisions pertaining <br />to confidentiality records, and applicable quality assurance regulations. <br /> <br />10, <br /> <br />LEAD-BASED PAINT <br /> <br />Contractor is required to test for lead based paint. The Building is subject <br />to Title X of the Housing and Community Development Act of 1992, <br />Section 1012 and 1013, as amended, the Lead Based Paint Poisoning <br />Prevention Act of 1971. Contractor is aware that projects built before <br />1978 receiving federal assistance for rehabilitation require a Lead Based <br />Paint Inspection and Risk Assessment by a ADHS Certified Inspector <br />with random testing of 28 of the 36 units, to include all painted surface <br />components, dust wipe samples and soil samples. Stabilization and or <br />abatement shall be conducted by DHS certified contractors and qualified <br />workers prescribed by law. <br /> <br />11. <br /> <br />MONITORING <br /> <br />All services performed and payments made pursuant to this agreement <br />shall be monitored according to the protocols set forth in Exhibit A. <br /> <br />- 8 - <br />
